| Private parties cannot bring lawsuits against the press under HIPAA, the federal health information privacy law, a Colorado federal court recently ruled. (University of Colorado Hospital Authority v. Denver Publishing Co., Aug. 2, 2004.) If followed by other courts, this decision will diminish one potential source of claims against the media for reporting information related to hospital patients.
The privacy provisions of the Health Information Portability and Accountability Act generally forbid health-care providers and insurers from disclosing, without consent, medical information about particular patients. |
